We are Kens Yard Ltd a private company registered at 16 Royal
Exchange Square, Glasgow, G1 3AG No: SC 355633. When you (the
person named on the order) place an order with us we do business
together under the following terms:
1. Prices
The price payable for the goods you order is set out on our web
site at the time you place your order, plus any charges for
delivery. Occasionally an error may occur with our web site and
goods may be incorrectly priced in which circumstances we will not
be obliged to supply the goods at the incorrect price. We must
receive payment for the whole of the price of the goods you order,
and any applicable charges for delivery, before your order can be
processed.
2. VAT
The prices we quote always include VAT at the applicable
rate.
3. Payment
All of our goods and services are offered to you on a payment
with order basis. Payment is accepted by most credit cards, debit
cards or by cheque. Our trade outlet also accepts cash. We will
only accept your order if it is accompanied by payment in full.
4. Purchasing Roof Trusses, Staircases, Doors, Patio Doors and
Windows
In order to purchase Roof Trusses, Staircases, Doors, Patio
Doors and Windows or other specially manufactured products from the
website you must complete the order process as laid out in the
website. The products purchased must be fully paid for by credit or
debit card. We do accept payment by cheque but will only process
your order once the funds have been cleared. We will also accept
cash at our Grangemouth office. All goods must be paid for in full
before an order is processed and put into production.
Ken's Yard will
acknowledge your order details by e mail or fax and will take care
to ensure that all details are accurate at the time of the
order.
Roof Trusses, Staircases, Doors, Patio Doors and Windows are all
sold subject to suitability and correct usage by you or your
contractor or your agents. Ken's Yard does not accept any liability
for incorrect usage or installation carried out by any third
parties. If you have a particular usage or product application
query please contact Ken's Yard who will confirm suitability. Where
Ken's Yard supplies any such goods in accordance with any drawing,
design or specification for the goods supplied and accepted by you
as your requirement for supply from Ken's Yard, Ken's Yard shall
have no liability to you arising from any defect attributable to
such drawing, design or specification so provided and agreed.
5. Dispatch
Provided that your order is received by us before 5pm, we will
normally process your order on the same working day and dispatch
your goods within a few working days thereafter. The goods become
your property as soon as payment is made in full.
6. Delivery
We will deliver your order to any UK address. Our standard
delivery uses a national carrier and in most cases you will receive
your goods within 3-5 working days. When your delivery arrives,
please check it for shortages and damages (open your boxes etc) and
let us know of any shortages or damages within 48 hours.
If you live off the beaten track or the carrier finds your
address more difficult to find your delivery may take a little
longer. With some of the more remote areas such as the highlands of
Scotland delivery can take several days. If a quicker delivery is
important please let us know and we can quote you for a premium
delivery option. Availability of these depends on where you are and
in some cases the time of day. This will be confirmed with you at
the time you place your order. If you order by post and request a
delivery option that is not available to your location you will not
be charged for it.
The delivery vehicle must be able to park at the delivery
address without committing a parking offence. If you know of any
parking restrictions or problems, they must be made known to Ken's
Yard at the time of ordering.
If a delivery is attempted on an agreed delivery date and the
driver is unable to gain vehicular access or the buyer (or their
representative) is not present to receive the goods, the buyer will
be liable for any redelivery costs incurred.
Please Note: We may be unble to ship some larger items to
remote parts of the UK due to courier restrictions. We reserve the
right to cancel any order for an Great Britain large item
shipment.
7. Receiving Orders
Unless we have your written authorisation, we will always
require an authorised signature when delivering goods to you. The
authorized signatory must be aged 18 or over.
8. Availability
We aim to promote and stock products that are continuously
available. However on occasions unexpectedly high demand may mean
that unfortunately we run out. If this happens we may delay
dispatch of your order for a couple of days while new stock is
obtained. If you have opted to accept a part order or specified a
premium delivery option, or we are expecting a longer delay we will
use the information you have provided with your order to keep you
informed of progress. You may contact us at any time to check on
the progress of your order.
9. Cancellation
Stock Items: If you wish to cancel your order you may do so at
any time until we dispatch it. Your order will be packed and
dispatched in a very short period. If you wish to cancel the order
you should do so by telephone and we will confirm that it has been
possible.
Manufactured or assembled to order items: Roof Trusses,
Staircases, Doors, Patio Doors and Windows: You may cancel
the order up to 48 hours after the payment has been made. To cancel
your order please notify us first by telephone and then in writing,
by fax, e-mail or letter. We must have written notification no
later than 48 hours after the time of purchase. Once the order has
been processed and production initiated any cancellation agreement
will be subject to financial penalties levied at reducing any
financial losses by Ken's Yard. Where agreement has been reached on
a cancellation, Ken's Yard will refund all monies due by the same
payment method within the next 30 days.
10. Returns - 30 day Refund
At Ken's Yard we want you to be fully satisfied every time you
purchase from us. In the unlikely event that an item does not meet
your expectations and once your order has been dispatched you may
return the goods at your expense for a full refund, without giving
a reason, provided the goods are with the original packaging, in
unused condition and you do so within 30 days of purchase. For
advice please contact the Kens Yard customer service team on 0844
488 0993.
If the product has been received either damaged or faulty, we
must be notified within 48 hours. We will then issue a full refund
for the price of the goods returned once your goods have been
received. The refund does not include your cost of the original
delivery and handling charge if the goods are not damaged or
faulty. The refund will appear on your card 3 or 4 working days
after this. Although we issue the refund straight away it can take
this length of time to work its way through the banking system.
Roof Trusses, Staircases, Doors, Patio Doors and Windows: Any
products that have been agreed as faulty, wrongly delivered, or
damaged beyond repair may be returned by the consumer. Ken's Yard
reserves the right to inspect all claims of damage, on site, before
any further action is agreed and the right to replace any damaged
parts before installation has begun. Ken's Yard will then arrange
for replacement parts or full items as necessary.
All agreed refunds will be made using the same payment methods as
used by the purchaser within 30 days of the goods being returned to
the manufacturer.
11. Twelve Month Guarantee
If any of the goods we supply fails to perform satisfactorily
due to faulty materials or workmanship you may return them to us
for a refund at any time in the first 12 months. All we ask is that
you provide an explanation of the problem and details of the
purchase. Some of the goods we sell carry longer manufacturer's
warranties; our guarantee is intended to give you additional piece
of mind and not as a substitute for the manufacturer's
warranty.
12. Our Mistakes
We are constantly updating our products prices and offers. We
are confident of our technology and staff but acknowledge that
human error is always possible. If goods are offered for sale
incorrectly we will always try to honour our offer. There may be
rare circumstances where it is not possible for us to do so. In
such cases we will contact you and explain the situation, if we are
unable to resolve the matter fairly with you we reserve the right
to refuse your order and refund any payment you may have made.
13. Unforeseen Circumstances
Where things like strikes, wars, acts of terrorism or even more
local things like power cuts and fires interfere in our business
with you, we will do our best to keep things going. We shall have
no liability to you for any failure which is due to such unforeseen
circumstances or any other situation outside our control.
14. Age Restrictions
Age restrictions apply to the supply of some goods. Where you
place an order for age-restricted goods such as solvents and
knives, you confirm that you are over the age of 18 and that
delivery will be accepted by a person over the age of 18. We
reserve the right to cancel your order if we reasonably believe you
are not legally entitled to order certain goods.
15. Variation
We may revise these terms and conditions on occasion. Such
revised terms and conditions shall apply to the use of our website
from the date of the publication of the revised terms and
conditions on our website. To ensure you are familiar with the
current version please check this page regularly.
16. Liability
Nothing in these Terms of Business is intended to affect your
statutory rights or to limit our liability for death, personal
injury or fraudulent misrepresentation resulting from our
negligence. If there is a problem you may receive a refund or
replacement under the terms of our Guarantee. Our liability to you
will always be limited to a full refund of the goods purchased. We
will not compensate for delivery delays or failures unless you have
requested a premium delivery option. In these circumstances our
liability to you will be limited to a refund of the delivery
charges you have paid. Our liability to you specifically excludes
compensation for indirect or consequential loss or damage however
it arises and except as described above will always be limited to a
refund of your payment.
17. Law
These terms of business will be interpreted and adjudicated
under Scottish law.
